As each offering differs in terms of service components, combined with many clients requiring bespoke components, we have individual Terms of Business for each service inline. EnthraSys Infotech introduces candidates to The Client on the understanding of Man power requirement sent by The Client for Both Contract to Hire and for Permanent Positions.

Terms of use of Services:

If you are not Agreed to these below legal terms and conditions or any other agreement preceding to this date, do not down load the profile or CVs we sent you.

The client shall pay the Company's payments under the payment terms mentioned in particular conditions. All payments are calculated according to the rate in effect at The Company, plus taxes.

If the Client or the initial Candidate cancels the employment contract during the warranty period starting upon the signing of the working agreement, The Company will do its best to find a replacement without any additional expenses for the Client (Not Applicable for any kind of Sales requirement)

The Client undertakes to notify EnthraSys Infotech immediately upon agreeing to engage a Candidate introduced by EnthraSys Infotech and the terms of the engagement. The Client agrees and undertakes to pay EnthraSys Infotech a Placement Fee amounting to a percentage of the gross annual salary.

The Placement Fee will be equal to 8.33% (Exclusive of GST and other applicable taxes) of the gross annual salary for all levels of management The Gross Annual Salary excludes the variable components offered to the Permeant Candidate. Applicable Tax would be charged on the placement fee as per the government rules (Taxable Services: Manpower Recruitment Agency). And 30% - 50% will be the placement fee of the gross annual salary for the requirement of Contract to Hire (C2H) and will be paid every month.

The payment has to be made by cheque/Online in favour of “EnthraSys Infotech” or as per The Client convenience.

An invoice will be sent to The Client after 15 days upon commencement of employment and Placement Fee is payable within 45 days from the date of joining of the candidate.

Introductions are confidential. If EnthraSys Infotech introduces a candidate to The Client then introduces to another third party, who engage the Candidate on either a full-time basis or as a contract, The Client agrees and undertakes to pay The Placement Fee.

Whilst every endeavor is made by EnthraSys Infotech to introduce satisfactory candidates to the Client, it is the responsibility of The Client to satisfy themselves for the suitability of an applicant before engaging them.

If invoices are settled and due to any reason Candidate resigns within 90 days of joining, then a free replacement for the same position will be provided. (Not applicable for Sales role)

Note: If the candidate either not employed with the client or the candidate is dropped it is only the responsibility of the client to intimate the same to us with immediate effect, and the same should be acknowledged by EnthraSys Infotech Authorized Person Otherwisethe Client is responsible to make the payment of the invoice which is raised on the particular candidate.

No variation in these Terms and Conditions may be made without prior written agreement from EnthraSys Infotech.

The term of this Agreement will be for a 1-year period with the ability of either party to terminate this agreement with a one-month notice period at any time, with an undertaking to settle all dues with each other, as part of the termination process.

Client shall be responsible for paying any and all Fees owed to EnthraSys Infotech under this Agreement.

The Company shall do its best to ensure the ability of the Candidates introduced to the Client and to sustain a high quality of service and integrity, but it does not guarantee expressively the ability of the Candidates introduced to the Client.

The Company is not responsible to the Client for any loss, damage, expenses, disputes, or incurred by the Client in connection with the Client's recruiting or hiring of Candidates.

The Company will use its best efforts to honor the agreement but forbears from a responsibility to deliver the anticipated result.
Payment/Payment Due Terms:

Interest on delayed invoices shall accumulate from the date when payment becomes due daily until the date of payment at a rate of 2.5% per month, and such interest shall increase monthly.

The Client has to notify The Company in writing within five days of termination that employment has been terminated.

If the Client defaults in payment of any invoice when due, the Client shall reimburse the Consultancy from and against all costs and expenditures incurred by the Consultancy in pursuing the debt, including legal costs on a counsellor and Consultancy’s collection agency cost.
